1. Acceptance of these Terms of Service

1. These Terms of Service constitute a binding agreement by and between SHUBHAM RANA, the merchant legal entity that owns and operates the FaceHop platform and service ("FaceHop," "we," "us," or "our"), and you ("you" or "your"). By accessing the Platform or using any part of the Service, you agree to become bound by these terms and conditions. If you do not agree to all these terms and conditions, then you may not access the Platform or use the Service. Nothing in this Agreement shall be deemed to confer any third-party rights or benefits.

2. Modifications of these Terms of Service

1. We may revise these Terms of Service from time to time, and the most current version will be available on the Platform. If the revision(s), at our sole discretion, is considered a material change, we may attempt to notify you by posting an announcement on the Platform. You are responsible for reviewing and becoming familiar with any modifications and agree to be bound by such modifications or revisions. Use of the Platform or the Service after any such revision(s) constitutes your acceptance of the terms and conditions of these Terms of Service as modified.

3. Description of the Service

1. The key functionality of FaceHop is to provide a platform designed to pair individuals ("users") together, based on compatibility and other factors, and to enable individuals to chat and communicate online through various media, including text, video, and picture sharing and linking and accessing third party social network platforms (collectively, the "Service").
2. According to relevant international regulations, FaceHop will not provide the Service in the following countries or territories:

1. Iran
1. Syria
1. North Korea
1. Crimea
1. So-called Donetsk People's Republic (DNR) and Luhansk People's Republic (LNR)
1. Russia
1. Belarus

4. User Accounts and Registration

1. To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. FaceHop reserves the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.
2. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions.

5. User Conduct

1. Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
1. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
1. Upload, post, or transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships
1. Upload, post, or transmit any content that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment
1. Interfere with or disrupt the Service or servers or networks connected to the Service
1. Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service

6. Intellectual Property Rights

1. The Service and its original content, features, and functionality are and will remain the exclusive property of FaceHop and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
2. You retain ownership of any content you submit, post, or display on or through the Service. By submitting, posting, or displaying content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to reproduce, modify, adapt, publish, translate, and distribute such content in any and all media.

7. Privacy Policy

1. Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

8. Termination

1. We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
2. If you wish to terminate your account, you may simply discontinue using the Service.

9. Limitation of Liability

1. In no event shall FaceHop, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Disclaimer of Warranties

1. The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. FaceHop does not warrant that the Service will be uninterrupted, timely, secure, or error-free.

11. Indemnification

1. You agree to indemnify, defend, and hold harmless FaceHop and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms of Service; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any User Contributed Content you create, post, or share on or through the Service.

12. Dispute Resolution

1. Any dispute arising out of or relating to these Terms of Service or the Service shall first be attempted to be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be submitted to the exclusive jurisdiction of the courts in Surat, Gujarat, India. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against FaceHop.

13. Governing Law

1. These Terms shall be interpreted and governed by the laws of India, without regard to its conflict of law provisions.
